What is copyright infringement?

Copyright infringement happens whenever someone copies or publicly uses a work without the owner’s permission. The second work must actually be copied from the first work or if you just happen to create a very similar work independently (with evidence it is an original), that is not infringement. The problems starts when one artist uses another artist’s work as their own. To be infringing, the second artist’s works does need not be identical. The standard for infringement is whether the second work is substantially similar to the original work.

Substantially similar means that an average person viewing the two works would easily recognize that the in one was copied from the other. There is no such thing as a “how much to change to not infringe”. Whenever you take someones work without permission, it is copyright infringement if it is recognizable.

Any unpublished website design and layouts are the property of Grace Computer & Internet Corp. (except any materials and content provided by customer).

Once final payment has been received, the website design ownership is transferred to customer. Website owner retains and reserves the rights to use any and all content developed.

Your/Client Company Own Design/Photo

Any images you/associated company have full ownership to the photo, materials and content provided may be used. If web design is for a company website and the contact person is the not the company owner, all rights of materials belong to the company the website is designed for.

CC0 (Creative Commons) Licensed/Public Domain Images

CC0 enables creators and owners of copyright or database-protected content to waive those interests in their works and thereby place them as completely as possible in the public domain, so that others may freely build upon, enhance and reuse the works for any purposes without restriction under copyright or database law.

In contrast to CC’s licenses that allow copyright holders to choose from a range of permissions while retaining their copyright, CC0 empowers the choice to opt out of copyright and database protection, and the exclusive rights automatically granted to creators and becomes “no rights reserved”.

NOTE: Images must be specified CC0, any other CC license may be subject to any other copyright restrictions

Royal Free/Stock Images (Paid)

Royalty free doesn’t mean free to use, it means you don’t pay a royalty payment each time you use the image. When you purchase a royalty free image either individually or a group at a time—you may use it as often as you like, as many times as you like. Grace Computer & Internet Corp. may also buy the stock image in your behalf after payment is made for service.
